Georgia Court of Appeals reversed trial court’s denial of summary judgment to an out-of-possession landlord in a dog bite case holding that dog bite statute is not applicable to out-of-possession landlord, and without evidence of actual knowledge of dog’s vicious propensities, the landlord was entitled to summary judgment. Not even a local ordinance purporting to create constructive knowledge on the part of the landlord could overcome this legal hurdle.
